PRIVACY POLICY

Your privacy matters to us. This Privacy Policy explains how Gill Financial Inc. (“Gill Financial,” “we,” “us,” or “our”) collects, uses, shares, protects, and retains personal information when you visit our website, apply for a loan, communicate with us, or receive loan services.

1. Information We Collect

We may collect information needed to review and service a loan application, including:

2. Social Insurance Number

We may ask for your Social Insurance Number (SIN) to help match you accurately with your credit bureau file, reduce identity errors, and support fraud prevention. Providing your SIN for this purpose is optional and choosing not to provide it will not, by itself, prevent you from qualifying. We may use another method to verify your identity or credit file.

3. How We Use Information

4. Consent and Credit Checks

We obtain consent where required. A credit check is not completed merely because you browse our website. When a credit report is required, authorization will be obtained through the application or a separate consent form. Each applicant, co-borrower, and co-signer must provide their own consent.

5. When We Share Information

We may share relevant information with credit bureaus, banks, payment processors, identity-verification and fraud-prevention providers, technology and document-service providers, professional advisers, collection agencies, courts, regulators, law enforcement, and other parties where permitted or required by law. We do not sell clients’ personal information.

6. Safeguards

We use administrative, physical, and technical safeguards appropriate to the sensitivity of the information. Access to sensitive information, including SIN, banking, identification, and credit information, is limited to authorized persons who require it for their work. No system is completely secure, but we take reasonable steps to protect information under our control.

7. Retention

We keep personal information only as long as reasonably needed to process and service applications and loans, meet legal and record-keeping requirements, resolve disputes, prevent fraud, and protect our legal rights. When information is no longer required, it is securely deleted, destroyed, or anonymized.

8. Your Rights

Subject to applicable law, you may request access to your personal information, ask for corrections, withdraw consent for optional uses such as marketing, and submit a privacy complaint. Some information may be withheld where the law permits or requires it.

9. Website and Electronic Communications

Our website may collect limited technical information such as IP address, browser type, pages visited, cookies, and access times. Email, text messages, and WhatsApp may not always be secure. Do not send passwords, online-banking credentials, or highly sensitive documents through unsecured channels unless instructed to use an approved method.

10. Privacy Incidents

If a privacy or security incident occurs, we will investigate, take reasonable steps to contain it, keep required records, and notify affected individuals and authorities where required by law.

11. Changes and Contact

We may update this Privacy Policy from time to time. The current version will be posted on our website with a revised date. Questions, access requests, corrections, consent withdrawals, and privacy complaints may be sent to:

TERMS & CONDITIONS

These Terms and Conditions govern use of the Gill Financial Inc. website, online forms, and related website services. By using the website, you agree to these terms. If you do not agree, please stop using the website.

1. Website Terms Only

These terms apply to website use. They do not replace any loan agreement, cost-of-borrowing disclosure, credit-consent form, pre-authorized debit agreement, co-signer agreement, guarantee, or other signed document. If there is a conflict, the applicable signed document and mandatory law will govern.

2. Applying for a Loan

Applicants must be at least 18 years old, have legal capacity to enter an agreement, and provide complete, accurate, current, and authentic information and documents. Submitting an application, documents, or attending an appointment does not guarantee approval, a particular amount, rate, term, processing time, or funding date.

3. Approval and Loan Terms

Approval and loan terms depend on underwriting, verification, affordability, credit history, banking history, income stability, existing obligations, fraud-prevention checks, and other risk factors. Final principal, interest, fees, repayment dates, and total cost of borrowing will be stated in the loan documents.

4. Accurate Information and Fraud Prevention

You must not submit false, altered, incomplete, misleading, or unauthorized information or documents. Gill Financial may verify information with appropriate sources where authorized and permitted by law. Suspected fraud or document alteration may result in an application being declined or cancelled and may be reported where permitted or required by law.

5. Credit Checks and SIN

A credit report may be requested only with the applicable authorization or where otherwise permitted by law. A credit inquiry may affect your credit score. We may ask for your SIN to improve credit-file matching and reduce identity errors. Providing the SIN for this purpose is optional and refusal alone will not result in disqualification.

6. Co-Signers and Co-Borrowers

Listing another person does not make that person responsible for a loan. A co-signer or co-borrower becomes responsible only after completing and signing the applicable documents. Their obligations are governed by the signed agreement.

7. Payments

Payments may be processed through pre-authorized debit or another approved method. Payment authority is governed by a separate authorization. Borrowers are responsible for providing accurate banking information, maintaining sufficient funds, reviewing payment schedules, and notifying Gill Financial promptly about payment concerns. Any fee or consequence for a failed payment must be permitted by the signed agreement and applicable law.

8. Appointments

Office visits are accepted by pre-scheduled appointment only. Walk-ins are not accepted. Scheduling an appointment does not guarantee loan approval or funding.

9. Acceptable Website Use

You must use the website lawfully. You may not commit fraud, impersonate another person, submit information without authority, upload harmful code, interfere with security or operation, attempt unauthorized access, scrape content without permission, bypass verification controls, or harass any person.

10. Website Information and Availability

We try to keep the website accurate and available but do not guarantee uninterrupted access, error-free operation, successful submission of every form, or that all information is always complete or current. Website content is general information and does not constitute independent legal, tax, accounting, insolvency, investment, or financial advice.

12. Third-Party Services and Links

The website may use or link to third-party services. Gill Financial does not control third-party websites and is not responsible for their content, availability, privacy, or security practices. A link does not necessarily mean endorsement.

13. Intellectual Property and Image Credits

Website content, branding, graphics, forms, and logos are owned by or licensed to Gill Financial Inc. and may not be copied or commercially used without written permission. Certain images are licensed through Freepik or other providers and remain the property of their respective owners.

14. Reviews and Testimonials

Reviews and testimonials reflect individual experiences. Results may vary. A review does not guarantee approval, a particular loan amount or terms, processing speed, or the same experience for another applicant.

15. Limitation of Liability

To the maximum extent permitted by law, Gill Financial is not responsible for losses caused solely by temporary website outages, technical problems outside our reasonable control, inaccurate information provided by a user, unauthorized use of a user’s device or account, third-party services, or reliance on general website content instead of final signed documents. Nothing in these terms limits liability or consumer rights that cannot legally be excluded.

16. Changes, Governing Law, and Severability

We may update these terms by posting a revised version with a new date. Changes do not retroactively alter an existing signed loan agreement. These terms are governed by Ontario law and applicable federal law. If one provision is invalid or unenforceable, the remaining provisions continue to apply.
